1. Acceptance and authority
By installing, approving a plan for, configuring, or using VoiceAgent for a store, the merchant represents that it has authority to bind that business and agrees to these terms. Shopify's terms and the merchant's agreement with Shopify also apply. If a person does not have that authority or does not agree, the app must not be used.
2. Eligibility and adult-directed use
VoiceAgent may be activated only for a store and voice experience directed exclusively to adults aged 18 or older. The merchant must complete the app's current eligibility confirmations before activation. These confirmations are the merchant's statements; they are not legal advice, provider endorsement, product certification, or a guarantee that the merchant's use complies with every applicable requirement.
VoiceAgent is for general-retail stores. It excludes vape, tobacco, nicotine, alcohol, weapons, and other age-restricted goods as described in the current merchant eligibility confirmations. An age confirmation does not make an excluded store eligible. These limits are eligibility requirements, not a claim of automated catalog screening. The merchant remains responsible for verifying that each product, market, advertisement, sale, and intended AI use is lawful and consistent with current Shopify and the applicable AI provider terms. The merchant must maintain required age gates, notices, geographic restrictions, product controls, and purchase safeguards.
3. Merchant responsibilities
- Offer only products the merchant is authorized to advertise and sell in every enabled market.
- Maintain accurate products, prices, availability, policies, FAQs, age notices, privacy disclosures, consents, and contact routes.
- Review the agent configuration and test the experience before and after material catalog, policy, theme, market, or provider changes.
- Keep Shopify accounts and credentials secure and promptly remove access that is no longer authorized.
- Investigate shopper complaints and independently verify important product, safety, legal, or purchase information.
- Use the app in accordance with applicable law, these terms, Shopify requirements, and current provider terms.
4. Acceptable use
The merchant must not use or enable VoiceAgent to:
- Facilitate unlawful or underage commerce, evade an age gate or geographic restriction, or make deceptive or unsupported claims.
- Provide medical, legal, regulatory, age-verification, or product- suitability advice, including unsupported safety assurances or pregnancy-related guidance.
- Give dangerous modification instructions, prohibited-purchase guidance, or instructions to bypass safety, abuse, usage, billing, or eligibility controls.
- Collect or expose passwords, authentication secrets, payment-card data, protected customer data, raw audio recordings, or other data outside the product boundary described in the documentation and privacy policy.
- Reverse engineer credentials, interfere with the service or its providers, misrepresent AI output as a human, or use the app outside the merchant's authorized Shopify store.
5. Features and limits
VoiceAgent supports storefront product discovery, comparisons, current product facts, synchronized policies, contact and checkout handoffs, and separately confirmed cart actions in stores that sell in USD, JPY, or KRW. It does not access customer profiles, accounts, payment details, order history or status; process refunds, cancellations, or order changes; provide phone, SMS, or WhatsApp service; or guarantee support for experimental languages. Every cart mutation requires a fresh shopper confirmation and server-side revalidation.
6. AI output and merchant review
Generative models can misunderstand speech, omit context, translate imperfectly, or produce inaccurate or unsuitable responses. Safety, grounding, redaction, and confirmation controls reduce risk but do not guarantee complete moderation, accuracy, accessibility, or legal compliance. The merchant must not represent VoiceAgent output as professional advice or as proof that a sale, issue resolution, or revenue event was caused by the app.
7. Plans, usage, and Shopify billing
A new eligible install receives one app-owned free trial that ends after 14 days, with up to 10 connected voice minutes and 20 answered typed questions, no overage and no Shopify charge. Each allowance stops independently. A paid upgrade ends the install trial. Uninstalling and reinstalling does not restart it while the store's records remain; once Shopify's shop-redaction process has deleted those records, a later install is treated as a new store. Existing legacy trials retain their original 30 voice minutes. Paid plans, included usage, and any merchant-enabled overage are presented in Shopify's managed-pricing approval flow. Shopify is the source of the final paid-plan charge. VoiceAgent may use ledger-backed connected time to estimate usage, enforce plan and merchant-selected limits, and reconcile permitted app charges. The merchant is responsible for reviewing the terms shown by Shopify before approving or changing a paid plan.
New voice-and-text plans include separate allowances. Voice captions, cards and tool lookups do not count as typed answers. Typed overage requires a completed answer; opt-in voice and text overage share one monthly cap. Unreported typed overage is waived at uninstall; already attempted billing events remain subject to verification. Approved legacy contracts keep their rates until the merchant approves a change.
8. Privacy and data use
The VoiceAgent privacy policy explains app-side retention, OpenAI and Google processing, merchant review settings, deletion, and service providers. The merchant is responsible for its own storefront privacy notice, lawful basis, consent and microphone disclosures, and responses to requests it controls.
9. Availability and changes
VoiceAgent depends on Shopify, OpenAI, Google, Vercel, Supabase, Upstash, merchant configuration, networks, browsers, and device permissions. The service is not guaranteed to be uninterrupted, error-free, or available in every market, theme, browser, or language. AZ Digital may change, restrict, or discontinue a feature to address security, safety, provider, legal, cost, or operational requirements. Material merchant-facing changes will be communicated where reasonably appropriate.
10. Suspension and termination
AZ Digital may block starts, suspend, or terminate access when eligibility lapses, required Shopify scopes are removed, billing is inactive or uncertain, a merchant breaches these terms, use presents an abuse or security risk, provider capacity is unavailable, or a law or provider policy changes. A merchant can stop using the service by disabling the widget and uninstalling the app. Uninstall and deletion follow the process described in the privacy policy and do not erase every outstanding billing, compliance, or provider record instantly.
11. Ownership and feedback
The merchant retains its rights in store content. AZ Digital and its licensors retain rights in VoiceAgent software, design, documentation, and service technology. The merchant grants the limited permission needed to process store content and configuration to provide the app. Feedback may be used to improve the service without identifying a shopper or disclosing the merchant's confidential information.
12. Disclaimers and liability boundary
To the extent permitted by applicable law, VoiceAgent is provided on an “as available” basis without a promise that AI output, provider availability, or merchant results will meet a particular purpose. Nothing in these terms excludes a warranty, remedy, or liability that applicable law does not permit the parties to exclude. This version does not state a contractual monetary liability cap or select an exclusive governing jurisdiction; applicable non-waivable law and remedies continue to govern.
13. Contact and terms changes
Questions about these terms can be sent to support@azdigitalinc.comor AZ Digital Inc., 338 Baverstock Cres, Milton, ON L9T 5K9, Canada. AZ Digital will update the date on this page when these terms change. Continued use after an effective update constitutes acceptance where permitted by applicable law; if the merchant does not accept an update, it must stop using and uninstall the app.
